Investment Fraud

Investment fraud generally occurs when there is theft as a result of manipulation of the market, theft from securities accounts, or deception of investors.  Specific examples of investment fraud include high-yield investment fraud, Ponzi schemes, pyramid schemes, advanced fee schemes, foreign currency fraud, broker embezzlement, hedge-fund related fraud, insider trading, and late day trading.

Investment fraud is investigated by a number of federal agencies, including the Department of Justice, the Federal Bureau of Investigation, and the Securities and Exchange Commission.  Securities fraud investigations have become increasingly common, and President Obama created a special division of the Department of Justice for the investigation of investment fraud and other financial crimes called the Financial Fraud Enforcement Task Force in 2009. 

Investment fraud is prohibited by a number of federal statutes, including the Securities Act, the Securities Exchange Act, the Investment Advisors Act, the Investment Company Act, the Trust Indenture Act, the Sarbanes-Oxley Act, the Private Securities Litigation Reform Act, and various provisions of the Federal Criminal Code.  Violations of these statutes are subject to serious penalties, including criminal penalties of up to twenty-years’ (20) imprisonment and fines of up to $5 million ($25 million for entities), as well as civil penalties including forfeiture, restitution, and loss of professional licenses.
